Terms & Conditions of Service

1. Definitions
- MotorPulse means MotorPulse Pty Ltd, including its representatives, employees, and subcontractors.
- Customer means the person or entity requesting Services, including private customers and Workshops.
- Workshop means a business (motor vehicle repairer, service centre, dealership, or similar) engaging MotorPulse for Workshop Technical Support.
- Vehicle means the motor vehicle worked on, diagnosed, or referenced during a Service.
- Services means DPF cleaning, diagnostics and inspections, advisory reports, and Workshop Technical Support (WTS), as set out in clause 3.
2. Acceptance of Terms
By booking or proceeding with any Service — including a Workshop Technical Support phone or remote session — the Customer agrees to these Terms.
3. Scope of Services
- DPF cleaning (on-vehicle)
- Diagnostics and inspections
- Advisory reports
- Workshop Technical Support (WTS) — remote, phone-based technical support to workshops
4. Service Locations
- MotorPulse operates a mobile, on-vehicle service across the Perth (WA) and Sydney (NSW) metropolitan areas.
- Travel or call-out availability outside these areas is at MotorPulse’s discretion and may incur additional fees.
- WTS is provided remotely by phone and remote-access software and is not limited by location.
5. Diagnostics & Advisory Nature
- Diagnostics are best-effort and not guarantees.
- Hidden or intermittent faults may exist.
- Recommendations are advisory only.
6. DPF Cleaning – Nature of Service
- DPF cleaning restores flow only.
- Does not repair structural damage.
- Performance depends on external factors.
7. DPF Condition & Failure Disclaimer
- DPFs are consumable and degrade over time.
- Internal condition cannot be fully assessed.
- Failure may occur after cleaning due to pre-existing issues.
MotorPulse is not responsible for DPF failure unless caused by lack of due care and skill.
8. Workshop Technical Support (WTS)
- WTS provides remote, phone-based diagnostic and technical guidance to Workshops, delivered by a MotorPulse technician.
- With the Workshop’s authorisation, MotorPulse may connect remotely to the Workshop’s diagnostic tools, computers, or software (for example, via AnyDesk or similar remote-access software) to view live data, provide guidance, or assist with software use.
- The Workshop is responsible for granting, supervising, and revoking remote access, and for ensuring only authorised personnel are present for and involved in a session.
- All physical work, repairs, part replacement, and final diagnostic decisions remain the Workshop’s responsibility. WTS is advisory only and does not transfer responsibility for the Vehicle, the repair, or the outcome to MotorPulse.
- MotorPulse is not liable for pre-existing faults, software conflicts, data loss, or damage to the Workshop’s tools, software, or a Vehicle arising from a WTS session, except where caused by MotorPulse’s lack of due care and skill.
- Any Workshop or customer data viewed during a WTS session is used only to provide the support requested and is not retained or shared beyond what is reasonably necessary for that purpose. To the extent the Privacy Act 1988 (Cth) applies, MotorPulse will handle any personal information viewed during a WTS session in accordance with the Australian Privacy Principles.
- Fees for WTS are charged on the basis agreed at the time of booking (for example, per session, per call, or hourly) and are payable in accordance with clause 13.
9. Indemnity
To the extent permitted by law, the Workshop indemnifies MotorPulse against any claims, losses, damages, or costs arising from actions taken, or not taken, by the Workshop or its personnel in reliance on guidance given under WTS — including any physical work, repairs, or software changes carried out by the Workshop — except to the extent such claims, losses, damages, or costs are caused by MotorPulse’s lack of due care and skill.
10. Pre-Existing Conditions
- MotorPulse is not responsible for pre-existing faults or wear in a Vehicle, or pre-existing issues with a Workshop’s tools or software.
- Absence of noted faults does not mean none exist.
11. Limitation of Liability
- Liability is limited to the cost of the relevant Service.
- No liability for consequential losses, including lost income, lost production time, or third-party claims, arising from a Service or from advice given under WTS.
12. Australian Consumer Law
Nothing in these Terms excludes rights under the Australian Consumer Law.
Where permitted by law, remedies are limited to re-supply of the Service or the cost of the Service.
13. Payment Terms
- Payment is due on completion of the Service, or for WTS, at the end of the session or per any agreed billing arrangement.
- Reports may be withheld until payment.
14. Cancellations
- Call-out fees may apply for mobile Services.
- Late cancellations, no-shows, or late-cancelled WTS bookings may be charged.
15. Governing Law
MotorPulse Pty Ltd operates in Western Australia and New South Wales. These Terms are governed by the laws of Western Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Western Australia, regardless of where the Service is provided.
16. Amendments
These Terms may be updated at any time. The version in effect at the time a Service is booked applies.
By proceeding with any Service, the Customer agrees to these Terms & Conditions.
